1. Introduction & Acceptance of Terms

Welcome to Infaq.ng (the "Platform"). These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Infaq.ng ("we," "us," or "our"), concerning your access to and use of our website and mobile application.

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms, then you are expressly prohibited from using the Platform and you must discontinue use immediately.

Our platform operates under an ethical, Shariah-compliant framework. All crowdfunding activities, campaigns, and transaction distributions are structured to uphold principles of transparency, direct benefit, and zero interest (Riba).

2. Eligibility & Account Registration

To access certain features of the Platform, including launching a fundraising campaign or managing recurring donations, you may be required to register for an account. By registering, you agree to:

  • Provide accurate, current, and complete information as prompted by the registration forms.
  • Maintain the security and confidentiality of your password and identification credentials.
  • Promptly update your account details to ensure they remain accurate and complete.
  • Accept full responsibility for all activities that occur under your user credentials.

We reserve the right to suspend or terminate accounts that contain false, misleading, or outdated information, or that are suspected of engaging in fraudulent activities.

3. Fundraiser Verification & Declaration

Before submitting or launching any fundraiser on Infaq.ng, campaigners must declare and agree that:

  1. The information and supporting documents provided are true, accurate, and complete to the best of their knowledge.
  2. Infaq.ng reserves the right to verify identity details, supporting evidence, and fundraising requests before approval or at any stage of the active campaign.
  3. All funds raised will be used solely for the specific purposes stated in the fundraiser, and any misuse will result in the suspension or immediate removal of the campaign.
  4. Submitting a fundraiser request does not guarantee approval. The Platform reserves the right to approve, reject, suspend, or remove any campaign failing to meet ethical, legal, or Shariah-compliance guidelines.
  5. Campaigners authorize the Platform to publish relevant fundraiser content, images, and progress updates for promotion and donor reporting.

4. Donation Allocation & Disbursement

Donors can contribute funds toward campaigns categorized as Sadaqah (General Charity) or Zakat (Obligatory Almsgiving).

Zakat-eligible campaigns undergo strict auditing by our Shariah advisory board to ensure funds directly benefit qualified recipients. The Platform enforces a 100% donation policy on Zakat campaigns, ensuring zero operational deductions are made from these specific obligatory almsgiving pools.

Disbursements to campaigners are processed transparently in accordance with pre-defined milestones. Infaq.ng acts as an agent (Wakil) to verify milestone completion before releasing subsequent financial tranches.

5. Prohibited Campaigns & Conduct

You agree not to use the Platform for any fundraising activity that violates ethical, legal, or Shariah regulations. Prohibited campaigns include, but are not limited to:

  • Campaigns involving interest-bearing transactions (Riba) or speculative contracts (Gharar).
  • Activities promoting gaming, gambling, or non-halal products.
  • Fraudulent requests, political lobbying, or campaigns violating Nigerian local legislation.
  • Campaigns lacking verifiable documentation for health, educational, or humanitarian claims.

Any attempt to exploit the platform, manipulate milestones, or provide falsified evidence will trigger immediate campaign termination and referral to regulatory authorities.

6. Limitation of Liability

Infaq.ng operates as an intermediary matchmaking platform facilitating transparent connections between ethical donors and verified campaigners. While we execute thorough document vetting, we make no warranties regarding the ultimate outcome of medical treatments, educational enrollments, or community projects funded.

To the maximum extent permitted by applicable law, Infaq.ng shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services.

7. Governing Law & Dispute Resolution

These Terms of Service and your relationship with Infaq.ng shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

Any disputes arising out of these terms shall be resolved amicably through mediation. Where disputes relate to Shariah-compliant campaign structures, they shall be referred to an independent ethical arbitration panel specializing in Islamic jurisprudence.
